Service Provision and Scope of Practice

Dr. Matt provides Ayurvedic medicine, integrative medicine, and lifestyle medicine services to patients in multiple states where he holds active medical licensure. Services may be provided:

• In-person: At our Portland, Oregon clinic

• Telehealth / Telemedicine: For patients located in states where Dr. Matt is licensed

By engaging Dr. Matt's services, you acknowledge that:

• You are receiving medical care from a licensed physician

• Your care is subject to the laws and regulations of the state where you are located when receiving services

• Dr. Matt practices within his scope of licensure and applicable state laws

• Services are provided in accordance with professional medical standards and ethics

Mental Health Therapy Services (Jamie Van Auken)

Jamie provides mental health therapy services exclusively to residents of Oregon and Washington. Services may be provided:

• In-person: At our Portland, Oregon clinic

• Telehealth: For Oregon and Washington residents only

By engaging Jamie's services, you acknowledge that:

• Jamie is licensed only in Oregon and Washington

• Services are only available to residents of these states

• You must be physically located in Oregon or Washington during telehealth sessions

• Services are provided under clinical supervision as required by state law

• Your care is subject to Oregon and Washington mental health practice laws

Establishing a Patient-Provider Relationship

For Medical Services (Dr. Matt Van Auken)

A patient-provider relationship is established when:

• You complete our intake forms and provide medical history

• Dr. Matt conducts an initial consultation or evaluation

• You agree to the terms of care and treatment recommendations

• Mutual agreement exists to proceed with ongoing care

For Mental Health Therapy Services (Jamie Van Auken)

A therapeutic relationship is established when:

• You complete intake paperwork including informed consent

• Jamie conducts an initial clinical assessment

• You agree to therapeutic goals and treatment approach

• Mutual agreement exists to proceed with therapy

Important: Use of this Website alone does NOT create a patient-provider or therapeutic relationship. A formal relationship is established only through the intake and assessment processes described above.

This Website and our services are not for medical or mental health emergencies.

By engaging mental health therapy services with Jamie, you consent to:

• The therapeutic approaches Jamie uses (EFT, IFS, EMDR, nervous system regulation, etc.)

• Communication necessary for your care

• Limitations to confidentiality as required by law (see Privacy Policy)

• You may experience temporary discomfort as part of the therapeutic process

• You have the right to ask questions about therapeutic approaches

• You may discontinue therapy at any time with appropriate termination procedures

Confidentiality and Privacy

All healthcare services are governed by:

• State privacy laws applicable to where services are provided

• Professional ethical standards (AMA Code of Ethics for physicians, AAMFT Code of Ethics for marriage and family therapists)

For mental health therapy services provided by Jamie Van Auken, confidentiality has specific legal limitations as required by Oregon and Washington law, including mandatory reporting of:

• Suspected vulnerable adult abuse, neglect, or exploitation

• Threats of serious harm to self or others when there is imminent risk

• Court-ordered disclosures

Telehealth / Telemedicine Services

We offer telehealth services via secure, HIPAA-compliant video conferencing platforms.

Telehealth for Medical Services (Dr. Matt Van Auken)

Dr. Matt provides telehealth services to patients located in states where he holds active medical licensure. By engaging telehealth services, you:

• Confirm you are physically located in a state where Dr. Matt is licensed at the time of each appointment

• Understand that services are subject to that state's medical practice laws

• Agree to be in a private, quiet location for appointments

• Have access to necessary technology (video-capable device, internet connection)

• Understand that technical difficulties may occasionally occur

Telehealth for Mental Health Services (Jamie Van Auken)

Jamie provides telehealth services only to Oregon and Washington residents. By engaging telehealth therapy services, you:

• Confirm you are physically located in Oregon or Washington at the time of each session

• Agree to be in a private, confidential location

• Understand that emergency services may be more difficult to access during telehealth sessions

• Have backup contact information in case of technical difficulties or emergencies

• Understand limitations of telehealth compared to in-person sessions

Telehealth Limitations

You understand that telehealth:

• May not be appropriate for all situations or conditions

• Requires adequate technology and internet connectivity

• May be limited by technical difficulties beyond our control

• May not allow for the same level of physical examination as in-person care

We reserve the right to determine whether telehealth is clinically appropriate for your situation and may recommend in-person care when necessary.

Appointment Scheduling, Cancellations, and No-Shows

Scheduling

All appointments must be scheduled through The Buddha's Medicine's Practice Better EHR system. By scheduling an appointment, you agree to:

• Be prepared or arrive on time for all types of appointments

• Have completed all required intake paperwork before your first appointment and subsequent appointments as appropriate

• Provide accurate contact and insurance information

We reserve the right to:

• Cancel or reschedule appointments with reasonable notice

• Decline to provide services to any individual

• Terminate the therapeutic relationship with appropriate notice and referrals

Payment, Billing, and Insurance

Fees and Payment

You are responsible for payment of all services rendered. This includes:

• Session fees (medical consultations, therapy sessions)

• Procedures or additional services

• Products purchased (herbal supplements, etc.)

• No-Show/Late/Cancellation fees when applicable

Payment methods accepted through our secure online system:

• Credit/debit cards

• HSA/FSA cards

• Venmo

Insurance Superbills

Out-of-Network Services: If we are out-of-network with your insurance plan, we can provide a superbill (detailed receipt) that you may submit to your insurance company for potential reimbursement. We cannot guarantee your insurance will reimburse for out-of-network services.

Client/Patient Responsibilities

By engaging our services, you agree to:

• Communicate openly with your provider about concerns or difficulties

• Respect professional boundaries with your provider

Medication and Treatment Responsibilities

• Inform us of all medications, supplements, and treatments you're using

• Report any adverse reactions or side effects promptly

• Not alter prescribed treatments without consulting your provider

• Seek emergency care when appropriate rather than waiting for your next appointment

Administrative Responsibilities

• Arrive on time for appointments

• Provide 24-hour notice for cancellations

• Keep your contact and insurance information current

• Pay for services as agreed

• Complete required forms and paperwork promptly

For Mental Health Therapy (Jamie Van Auken)

• Engage actively in the therapeutic process

• Complete any homework or between-session practices discussed

• Communicate honestly about your experiences and concerns

• Respect boundaries regarding contact between sessions (emergency situations excepted)

Professional Boundaries

Therapeutic Relationship

For mental health therapy services, we maintain professional boundaries to ensure ethical, effective care:

Appropriate Contact:

• Scheduled therapy sessions

• Brief email or phone contact for scheduling or administrative matters

• Emergency contact as previously arranged with your therapist

Inappropriate Contact:

• Social media friend requests or following your therapist's personal accounts

• Personal gifts of significant value

• Social or business relationships outside of therapy

• Contact for purposes other than therapeutic care

Dual Relationships: We avoid dual relationships (therapist-client relationship + another relationship such as friendship, business partnership, etc.) as they can compromise the therapeutic relationship and are typically prohibited by professional ethics codes.

Medical Relationship

For medical services, professional boundaries include:

• Scheduled medical appointments

• Appropriate clinical communication regarding your care

• Professional, respectful interactions

We do not:

• Prescribe controlled substances for pain management as our practice focus is integrative and lifestyle medicine

• Provide medical care to family members or close friends due to ethical concerns

• Engage in dual relationships that could compromise medical judgment

Discharge and Termination

Our Right to Terminate

We reserve the right to discharge you from our practice if:

• You repeatedly miss appointments or fail to provide adequate cancellation notice

• You fail to pay for services as agreed

• You engage in threatening, abusive, or inappropriate behavior toward staff or providers

• You fail to follow treatment recommendations without discussion or reasonable explanation

• We determine that we cannot provide the level of care you need and appropriate referrals have been provided

• There is a fundamental breakdown in the therapeutic/medical relationship

If we terminate the relationship, we will:

• Provide written notice when possible

• Offer appropriate referrals to other providers

• Provide a reasonable period for you to secure alternative care

• Transfer records as appropriate with your authorization

Your Right to Terminate

You may discontinue services at any time. We recommend:

• Discussing your decision with your provider when possible

• Attending a final session for appropriate closure (particularly important in therapy)

• Requesting copies of your records if desired

• Obtaining referrals to other providers if continuing care is needed

Coordination of Care

With your written authorization, we may coordinate your care with other healthcare providers. This may include:

• Communicating with your primary care physician

• Consulting with specialists involved in your care

• Coordinating between Dr. Matt and Jamie for integrated care approaches

• Sharing relevant medical information with other providers

You have the right to:

• Refuse authorization for coordination of care

• Limit which providers we may contact

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Jurisdiction
